Staff said the property sits in the West Riverfront district and that Silver Creek creates a steep drop‑off in the backyard area, which makes conventional rear‑yard fencing and shed placement impractical. The applicant, Jennifer Netherton, told the board she wants to enclose a side/landing area to keep her dogs and children safe; she provided photos and explained the fence would be 12 feet from the road and the shed would sit inside the fenced area but still behind the house facade.
Neighbor Tim Netherton supported the request, saying the lot effectively lacks a usable backyard and the fence would provide needed outdoor space. Board members found the proposal would not obstruct sight lines on the public road, would not create a public‑safety problem and would preserve build‑line interests where possible. The board approved both variances with a condition referring to the submitted site plan as the controlling document.
Board members asked staff to ensure the approval is tied to the plan presented, and the clerk confirmed the motions were made to approve the fence and then the shed with the plan referenced as the record.
