Board approves 4-lot subdivision off County Road K near Highway 52; commissioners urge road maintenance agreement

During the May 6, 2025 public hearing, the Morgan County Board of County Commissioners approved a 4-lot minor subdivision proposed by applicant Jay Greener for land owned by Buck Creek LandCO, LLC.

Planning Administrator Nicole Hay summarized the application for a 24.43-acre parcel in the Agricultural Production zoning district (Lot 1: 3.46 acres; Lot 2: 8.00 acres; Lot 3: 7.23 acres; Lot 4: 5.74 acres). Hay said referral responses were included from Xcel Energy, the Wiggins Fire District and the Colorado Department of Transportation, that all lots would be served by Morgan County Quality Water, and that a 40-foot access easement will be created with a shared access acknowledgment to be recorded if approved.

Applicant Jay Greener said he expects to maintain the road into the subdivision and discussed the costs of creating a separate access to Highway 52. Chairman Jon J. Becker and Commissioner Bernhardt suggested an HOA or a recorded road maintenance agreement to ensure long-term upkeep; the Sheriff, Dave Martin, noted the Sheriff's Office does not enforce HOA covenants and that enforcement would be a civil matter.

A public commenter, Keith Knickrehm of 4629 County Road K, asked whether there must be a financial reason to subdivide and what the applicant's plans were for an outlot. Greener responded he plans another three-lot subdivision in the future.

Commissioner Timothy A. Malone moved to approve the 4-lot minor subdivision; Commissioner Kelvin S. Bernhardt seconded and the Board voted 3–0 to approve. The approval record notes the property is in the Wiggins Fire District and that Right to Farm notices were provided.
