Morgan County commissioners met May 28, 2025, and approved several land‑use and zoning measures while postponing more complex energy and subdivision rule changes for additional review.
The Board voted 3‑0 to adopt Resolution 2025 BCC 23, granting the Greener Minor Subdivision, a four‑lot minor subdivision in the SE¼ of Section 11, Township 2 North, Range 60 West. Commissioner Kelvin S. Bernhardt moved for approval; Commissioner Timothy A. Malone seconded. The resolution record states the subdivision conforms to the county comprehensive plan, includes recorded shared‑driveway access off County Road K, and assigns responsibility for on‑site drainage and water to the landowner and successors rather than Morgan County.
Also on the consent portion of the agenda, the Board approved a Road Use Agreement with South Platte Solar, LLC; Planning Director Nicole Hay told commissioners that Planning and Zoning had received all prerequisites for the agreement. The Board likewise approved an Amended Plat application for Quiet Acres (property known as 15445 Hwy 144, Fort Morgan), under which a 40‑foot road easement over Lot 2 would be reduced to 20 feet and relocated to the west; the county noted CDOT had issued a revised access permit and staff concluded the change would not increase existing nonconformity.
The Board approved zoning regulation amendments related to variances (adding a bulk requirement definition and removing variance authority over maximum residences per parcel) and amendments to Wireless Service Facilities language (moving the permitted‑use designation into the use table), each on 3‑0 votes.
Planning staff, legal counsel and commissioners emphasized that these approvals reflect technical and process clarifications rather than sweeping policy shifts. Nicole Hay summarized application completeness and regulatory compliance for each item. All approved motions were unanimous: Becker (yes), Malone (yes), Bernhardt (yes).
What’s next: The Board continued two more complex public hearings to its June 17, 2025 meeting: (1) proposed amendments for solar collector facilities, battery energy storage systems (BESS) and wind energy facilities, and (2) comprehensive amendments to the Subdivision Regulations (major and minor subdivision procedures and standards). Those continuations followed public comment and stakeholder requests for additional review and specific language changes.
