The Morgan County Board of County Commissioners on Aug. 5 denied a Special Use permit application by Gregory and Regina Dardanes to develop a commercial storage facility (conex boxes, storage trailers and covered parking) at 968 N. Custer Street in Brush.
Planning Administrator Nicole Hay told the board the parcel is zoned Rural Residential and lies partly in a Special Flood Hazard Area. Staff concluded the proposed commercial storage use was not compatible with surrounding residential properties and noted the application did not demonstrate a public need; staff therefore recommended denial. At the Planning Commission hearing, the commission voted 4–2–1 to recommend conditional approval, but the board heard multiple neighborhood objections at the county hearing.
Several neighbors, including Michelle Kelly, Linda Hansen, Wanda Blake and Troy Blake, spoke in opposition citing concerns about flooding, drainage, reduced air flow, property upkeep, potential increased crime and incompatibility with the surrounding residential area.
Commissioner Kelvin S. Bernhardt moved to deny the special use permit; Commissioner Timothy A. Malone seconded the motion and the board voted 2–0 to deny the request (Chairman Becker recused himself from the hearing). The board’s denial means the applicant must not begin the proposed storage development under county authority.
What happens next: The applicants may revise and reapply or seek alternative zoning or sites; any future application should address buffering, drainage, floodplain anchoring, geotechnical infiltration documentation and evidence of public need.
