Morgan County adopts revised road-use agreement template for energy projects

County Attorney Kathryn Sellers told the board the template replaces the term 'applicant' with 'permittee' and includes several new requirements and prospective cost-responsibility provisions. The changes were presented as a template for future use by developers seeking to use county roadways or rights-of-way during construction and operations.
Commissioner Timothy A. Malone moved to approve the template; Commissioner Kelvin S. Bernhardt seconded the motion and the board voted 3–0 to adopt it. The board did not attach additional project-specific conditions at the meeting; the template will be applied on a case-by-case basis to future permit requests.
What happens next: County staff will use the revised template when negotiating road-use terms with prospective energy project permittees. Any specific costs, mitigation measures and survey or construction requirements will be established in project-level agreements.
