The Morgan County Board of County Commissioners voted 3‑0 March 4 to rezone approximately 47.8 acres at 29870 U.S. Highway 6 (Brush) from Agricultural/Agri Business to Commercial.
Planning Administrator Nicole Hay summarized the application from NYH Solutions (Ashley and Robert Farnam) and noted the property historically housed a livestock auction, restaurant and retail uses. The Planning Commission recommended approval by a 7‑0 vote. During the board hearing, applicant Ashley Farnam said the property could support a mix of commercial activities and indicated that a future special‑use application would detail plans for a firearm and archery range intended for youth programming and law‑enforcement use.
Monty Torres, City Administrator for Brush, spoke in support of the project but said the city will work with the applicants to clarify whether a section‑line right‑of‑way exists along the eastern section line and to determine water‑line ownership and service issues. Chairman Jon Becker and commissioners emphasized that the rezoning decision applies only to the zoning designation; any specific uses that require demonstration of available water, permits, or special‑use approvals would be addressed in subsequent applications.
Commissioner Kelvin Bernhardt moved approval; Commissioner Tim Malone seconded. The motion carried 3‑0.
