Planning commission approves conditional use for Marvin Parkway car wash with 5 a.m.–9 p.m. hours

The Opelika Planning Commission approved a conditional-use permit allowing a mixed-style car wash to replace an older self-service facility at 2002 Marvin Parkway, with conditions on landscaping, screening and noise and an operating-hours limit of 5 a.m. to 9 p.m.
Planning staff presented the application on behalf of applicant Kip Oldham, who said he represents owner Kumar Patel. Staff recommended conditional-use approval provided the developer revises landscaping to meet gateway-corridor standards, screens dumpsters and mechanical equipment, provides underground utilities and mutes vacuum motors and other exterior noise to comply with Section 8.6 of the zoning ordinance. Staff also asked for a lighting plan that provides on-site visibility without off-site light pollution.
Kip Oldham told the commission the owner would like a defined operating window and proposed 5 a.m. to 10 p.m., and said the site would use cameras, parking-lot lighting and a gate to deter off-hours activity. A nearby resident urged earlier closing, saying later evening hours could bring trouble.
After discussion about queuing (to avoid backing into Marvin Parkway) and noise mitigation, staff proposed and commissioners adopted an amendment setting operating hours from 5 a.m. to 9 p.m. A motion to approve conditional use with the staff conditions, including the amended hours, was moved, seconded and passed on voice vote.
The commission clarified that the conditional-use determination is decided at this level and does not go as a recommendation to city council.
Required follow-ups include the developer submitting a lighting plan, showing how vacuums and mechanicals will be muffled to meet Section 8.6, and providing required construction and utility plans for engineering review.
