Resident says Track J fence violates PUD; RTS says it will remove damaged sections

William Ryan, an Oviedo resident, told the City Council the existing chain‑link fence on Track J is “a direct violation of city law and must be removed,” urging the city to issue a notice of violation and require removal within 30 days.
Ryan showed photographs and argued Exhibit E of the Track J PUD explicitly prohibits chain‑link fencing and that the fence is an ongoing, selective enforcement problem. “This means I can't put up a chain‑link fence. This means my neighbor can't put up a chain‑link fence, and this means RTS can't leave one up,” he said.
Rob McAdams, speaking for RTS, said the company performed clearing work and has been evaluating options to remove sections of fence that are deteriorated. “Our desire is to remove it based on its bad condition,” McAdams said, while seeking staff guidance about whether RTS is subject to the Exhibit E architectural guidelines.
City staff told the council that portions of Track J are subject to the homeowners‑association documents that incorporated Exhibit E, but RTS’s parcel is not included in those HOA documents. Staff said during an on‑site inspection the city observed some fence sections in disrepair; code standards require fences to be maintained in an upright condition. The city attorney said he will follow up with staff and with RTS to clarify applicability and next steps.
The council did not take formal enforcement action at the meeting; staff was asked to follow up with RTS and return with clarified legal and compliance options.
The matter remains open for staff action and possible future council consideration.
