The Warren County Zoning Hearing Board on May 20 unanimously approved a variance that will allow reduced front-yard setbacks so a proposed 1,120-square-foot dwelling can be built on a triangular corner lot in Elk Township.
Chair David Miller said the application, filed for Tax Parcel WN-006-317120 by John D. Anderson of Russell, Pa., requires relief under Article VIII, Section 808.8 of the Warren County Zoning Ordinance when an applicant asserts the ordinance creates an unnecessary hardship. The parcel is 0.69 acres and is a corner lot with an irregular triangular shape, Miller said.
Rod Fasenmeyer, representing Anderson at the hearing, explained that the lot’s shape and the existence of two front yards prevent the proposed house from meeting both 50-foot front-yard setbacks. The application seeks a 6-foot reduction to the 50-foot setback on Peterson Road and a 34-foot reduction to the 50-foot setback on Hodge Road to accommodate the 1,120-square-foot dwelling.
Zoning Officer Aubree Gonzales told the board that required notices had been mailed to property owners within 300 feet, the hearing had been advertised in the newspaper, and the property had been posted. Gonzales said she had no objection to the variance request. Solicitor Timothy Bevevino also said he had no problem with the request. No other testimony or evidence was presented and no objectors attended the hearing.
Board member Edwin W. Atwood moved to approve the variance and Donald C. Saporito, Sr. seconded; the motion carried unanimously. The board adjourned at 10:06 a.m.
The variance approval permits the reductions requested in the application; the transcript does not specify final engineered setback lines, permit conditions, or any additional conditions the board may impose in written findings. The applicant was represented at the hearing by Fasenmeyer; John D. Anderson was not in attendance.
