The Lincoln County Planning Commission voted unanimously to approve a conditional use permit for temporary fireworks sales at a commercial property adjacent to Highway 106, after staff recommended approval with seven conditions.
Toby Brown, county planning staff, told the commission the subject parcel — the former Thorton Carpet building just off the I‑29 exit — is zoned C (commercial) and the applicant proposes a temporary tent in the parking lot. Brown said staff had worked with the applicant on a site plan to keep customer parking outside the right of way and to place the tent adjacent to the building. He recommended approval with seven conditions outlined in the staff analysis.
Sean Wong of Independence LLC, the applicant, told the commission the booth would operate June 27 through July 5, with hours starting about 9 a.m. and extending to roughly 11 p.m. depending on sales, and that he and his spouse would staff and handle security for the operation.
Commissioner Green moved to approve the permit with staff’s seven recommendations; Commissioner Boots seconded. After brief comments from commissioners, the board conducted a roll call and Commissioners Mosier, Boots, Schmidt, Green and Scott voted yes.
The approval allows the temporary tent‑based retail sale under the conditions specified by staff; Brown noted any future desire to sell fireworks from a permanent structure would require a separate county approval. The staff report and the motion make clear that conditional use permits may be appealed to the Board of County Commissioners by filing with the County Planning and Zoning Office within five business days.
The commission did not receive any public testimony in opposition during the hearing. The applicant may proceed under the conditions adopted by the commission; appeals and related procedural deadlines were explained at the meeting.
