ZIONSVILLE
The Zionsville Town Council held a first reading and public hearing on an ordinance to vacate part of a variable drainage easement on Lot K-34 in the Club at Holiday Farms. Planning staff and the public-works director reported no objections from town departments or utilities and noted the vacation would not alter the 30-foot rear-yard building setback.
Jeff Rudolph, the property owner, told council that the recorded variable drainage easement extends into his backyard beyond the building-setback line and that an engineering review found only minimal overland flow through the area. "As you were to view the property today under final grade, there's clearly not a need for that" large easement, Rudolph said.
Lance, the town's public-works director, explained the subdivision's drainage is privately owned and maintained by a homeowners association and described the request as an easement vacation rather than an encroachment issue. He told the council the department had no objection to the vacation.
Councilor Melton moved to introduce the ordinance and Councilor McElderry seconded; the motion to introduce passed 6-0. The council set the final hearing for July 20 at 7:30 a.m., at which point it will consider final action.
What happens next: the petition will return for a final hearing; if the council approves the vacation at final reading, the easement will be vacated subject to the remaining plat setbacks and any applicable permitting procedures.
