Canaan Planning Board approves ADU-related subdivision rule changes, recommends Highland Avenue easement and conditionally accepts Martineau maintenance pact

The Canaan Planning Board on Feb. 12 approved changes to the town's subdivision regulations meant to align with recent state changes to the definition of accessory dwelling units and took three procedural actions on local property matters.
Chair John Bergeron said the state has revised the definition of accessory dwelling units (ADUs) but that the change “does not materially affect Canaan” because the town lacks zoning. Tom Milligan questioned how the new ADU definition would relate to properties in the Historical District; Bergeron responded it would not substantially change local practice. After the public hearing, Bryan Armburst moved and Nan Stone seconded a motion to adopt the subdivision regulation amendment; the motion passed unanimously.
The board also reviewed a correspondence item granting the town a 50-by-50-foot turnaround at the end of Highland Avenue and voted to recommend transmitting the easement to the Selectboard. Nan Stone moved and Nancy Rosenthal seconded the recommendation; the motion was approved unanimously.
On the Edward and Gail Martineau subdivision on Whispering Winds Way, the board reviewed a maintenance agreement that the board said explicitly includes all property owners and matches prior minutes. Stephen Freese moved and Bryan Armburst seconded acceptance of the agreement provided that a note referencing the maintenance agreement is placed on the recorded plat; the motion carried with Nancy Rosenthal recorded as an abstention.
Earlier in the meeting the board approved minutes as revised; Stephen Freese moved and Nan Stone seconded the minutes motion, which passed with Dan Bragdon and Nancy Rosenthal recorded as abstaining. The meeting adjourned at 6:56 PM.
Next steps: the Highland Avenue easement will be transmitted to the Selectboard for consideration, and the Martineau plat must be annotated with the maintenance-agreement note before final acceptance is complete.
