County staff pulls coastal ADU item for administrative review after state-law review

Staff said the legislature appears to have intended ADUs to be processed administratively, even in coastal areas, and that the county must consider Coastal Act issues as part of that staff-level review. "The legislature appears to have intended them to be staff level decisions," the county secretary said. County counsel acknowledged that the department is continuing to study the law's local appealability implications; preliminary reading suggests a coastal-ADU approval may not be subject to a public hearing and may not be appealable to the California Coastal Commission, though county-level appealability questions remain under study.
Staff did not take a commission vote; the item was removed from the agenda and staff said the chief's review will include public-notice and comment opportunities under the administrative process. Commission discussion emphasized caution in processing given the potential for litigation and the short statutory timelines that govern ADU approvals under state law.
