Commission reviews amendment to boundary-line adjustment rules, proposes adding 'boundary line establishment'

Centerville planning staff presented a redline amendment to the city’s exchange-of-titles code to align local procedures with recent state updates on boundary-line adjustments and boundary-line establishments.

Staff said the redline largely follows state code language and recommended adding "boundary line establishment" to the city code rather than omitting it. The staff explanation emphasized that the three types—simple adjustment, full adjustment and boundary-line establishment—have distinct characteristics and review levels. For example, staff said a simple boundary-line adjustment typically does not affect easements or public rights-of-way and can be handled by the zoning administrator with a survey, while a full adjustment that affects public utility easements or nonconformities may trigger platting and additional review.

“Boundary line establishment is where there is vagueness of where the boundary line is,” a staff member said, noting that the establishment process often resolves historical fence lines or overlaps recorded long ago and that, where owners agree, the zoning administrator can process an establishment without a plat.

Staff also described a conveyance document that can be recorded in lieu of a plat to implement certain boundary adjustments; on full plats the city attorney, city engineer, community-development director and mayor must sign to ratify the plat for county recording.

No formal vote was taken on the redline during the meeting; staff said they would refine the redline, coordinate with the city attorney and bring the item back for further comment and likely a public hearing if necessary.
