During the public-comment portion of the Nov. 18 meeting, Patricia Reinert asked the Planning Commission for advice about family property on Madonna Drive after her mothers death. Reinert said two brothers are looking to sell the family land and house and she wanted to know how to proceed.
Commissioners and staff explained that Act 319 is a county-level covenant and she should consult the county and consider legal counsel about possible repercussions and options. If the county determines a break-off of less than one acre is the only available option, Reinert was advised she would need to pursue a variance for minimum lot size; if granted she would then follow the standard subdivision process.
The commission recommended Reinert seek guidance from the county Act 319 administrator and a lawyer before submitting any subdivision or variance applications. No official action or vote resulted from the public comment.
