Alderperson Gerbers moved and Alderperson Hurkman seconded a motion to go into closed session under Wisconsin Statute 19.85(1)(e) "to deliberate or negotiate the purchase of public property, investment of public funds, or conducting other specified public business when competitive or bargaining reasons require a closed session." The stated subject was a Development Agreement with Golden Meadow Estates, LLC. The motion carried.
After completing the closed-session portion of the meeting, Alderperson Gerbers moved and Alderperson Hurkman seconded to reconvene into open session; that motion also carried. The public minutes do not record any votes, decisions, or terms of any Development Agreement discussed in closed session.
Because Wisconsin statute permits nondisclosure of certain bargaining positions and terms discussed under § 19.85(1)(e), the minutes appropriately record only the council’s motion to enter closed session and the reconvening to open session. The record does not disclose whether any direction was given to staff or whether a draft agreement exists in a circulating form.
