NHDES says culvert work on Pettengill Road likely requires wetland permit; town to monitor

The Wetlands Permitting Specialist in the NHDES Land Resources Management Water Division reviewed materials and responded that a wetland permit or notification is required, citing Env‑Wt 901.03 (exemptions) and guidance in Part Env‑Wt 308. The specialist said the site appears to be in a Priority Resource Area and may involve wetland features that require verification by a certified wetland scientist; floodplain location increases the likelihood of permit requirements.
The NHDES response also noted that the Natural Resources Conservation Service (NRCS) may investigate the site further. The Select Board said it will monitor NHDES permitting progress and related NRCS actions. The board did not take a formal enforcement vote at the Feb. 9 meeting; the NHDES guidance in the record frames the next steps for permitting and technical review.
The record to date is administrative: NHDES advised that a permit/notification is required and identified the statutory and regulatory sections to consult. Any required permit, wetlands determination, or enforcement action would follow the agency’s procedures and any subsequent technical findings from NRCS or a certified wetland scientist.
