Lewisville council sets public hearings for two residential rezoning proposals

The Lewisville Town Council voted July 9 to call public hearings on two separate rezoning proposals that would permit planned residential developments on agricultural land.
Planning Director Lynn Cochran told the council that Case L117, Conrad Farm North, seeks to rezone land from agricultural to agricultural‑conditional to allow a planned residential development of 31 homes. ‘‘This is a request to rezone from agricultural to agricultural conditional, specifically for a planned residential development,’’ Cochran said, adding that the planning board reviewed the application on June 10 and voted unanimously to recommend approval.
Council Member Jerry Gallagher asked whether his residency in the Conrad Farm area would create a conflict of interest. Town Attorney Al Andrews explained the legal distinction between quasi‑judicial and legislative proceedings and cited North Carolina General Statute 160D‑109, which governs conflicts of interest for governing board members. Andrews said the statute bars a member from voting on a development decision when the outcome is ‘‘reasonably likely to have a direct, substantial and readily identifiable financial impact on a member’’ but noted that legislative rezoning decisions generally do not trigger the same disqualification standards as quasi‑judicial hearings.
After the brief exchange, Council Member Fred Franklin moved to set a public hearing on Conrad Farm North for the council's August meeting; the motion was seconded and approved unanimously.
Cochran also presented Case L118, Marion's Landing, describing a resubmitted application from applicants 4 Star and McAdams for a conditional planned residential development of 61 single‑family homes. The council voted to set a public hearing for Marion's Landing as well; the minutes record the second for the motion as coming from "council member Alvin." The council approved the motion to set the hearing.
Both items are now scheduled for public hearings so residents may provide input and the council can receive a fuller record before acting on any rezoning ordinances.
The council did not take final zoning action at the July 9 meeting; each matter will return for public comment and deliberation at the advertised hearings.
