According to the parish attorney, the court earlier entered a judgment awarding the parish approximately $970,000 for delays and failure to complete the project. The parish filed a large brief with 18 exhibits seeking an additional $1,700,000 in damages plus $36,000 in attorneys’ fees; the total amount the parish asked the judge to award is $2,737,956.63.
The attorney told the council the next stage is execution of the judgment — attempting to attach funds from the contractor or surety — and that he is confident the parish’s motion will be granted. Council members asked how any awarded fees would be handled; the attorney said recovered funds would be paid into the parish general fund.
What’s next: If the court awards the additional damages, parish legal staff will seek to execute on the judgment and return funds to parish coffers; the attorney agreed to provide the council with copies of the filings and public dockets.
