Franklin County approves routine motions, signs conflict-counsel agreement; Kiwanis lease revisions requested

Franklin County Commissioners on March 25 approved routine administrative actions, authorized a conflict-counsel agreement and asked the Kiwanis Club to revise a proposed lease for a burger booth at the rodeo grounds.
Commissioner Boyd Burbank moved to adopt the meeting agenda; Commissioner Robert Swainston seconded and the vote was unanimous. The board later voted unanimously to pay bills after discussing that Cache County Jail is no longer taking weekend inmates and that the sheriff is sending those inmates to Caribou County; commissioners said they will discuss a contract with Caribou County commissioners to formalize those transfers.
Commissioner Burbank moved and Commissioner Swainston seconded to approve the March 11, 2024 minutes; that motion also passed unanimously. The board voted to sign the John Joseph Bulger Agreement for Conflict Counsel after review by the county attorney.
On the Kiwanis Club lease, George and Connie Young (president and secretary) presented a proposed lease for a new burger booth under the rodeo stands. County review and the county attorney recommended the following revisions before returning the lease to the board: limit an initial term to one year rather than 30 years with automatic 90-day renewal wording allowing either party to terminate with 90 days' notice; prohibit subleasing by the Kiwanis or the Rodeo Committee; clarify that the $300 previously paid to the Rodeo Committee is for post-event cleanup and not meant to cover the lease or utilities; and specify an amount for required liability insurance. George and Connie Young said they will make the changes and bring the lease back to a subsequent meeting.
At 9:50 a.m. the board voted unanimously in a roll-call to enter executive session under Idaho Code §74-206(1)(a) to consider personnel matters; those present for the executive session were Commissioners Swainston and Burbank, County Attorney Vic Pearson and Clerk Camille Larsen. The board exited executive session at 10:30 a.m. and later adjourned at 10:32 a.m.
