Council members and developer representatives reported an out-of-session conference among staff, counsel and Rockefeller attorneys. One council member summarized the agreed language as obligating the redeveloper to "abide by any bird glass ordinance adopted by the city within one year of the affected date" of the first amendment, giving the city time to adopt a bird-friendly standard. A developer representative and council negotiators said Rockefeller had committed to work toward installing bird-friendly glass on the affected buildings.
Council agreed to carry the items as amended and staff said the updated amendment text would be distributed and added to the packet before the end of first reading. Multiple council members praised the administration, outside counsel and Rockefeller for reaching agreement on the language; some members stressed that other priorities such as parking, union labor and affordable housing remain part of their evaluation of major development agreements.
The council carried the set of development resolutions (CD 9–12) as amended on the council floor.
