Village steps aside as state reviews disputed structure at Stop 42

The Village of Michiana council on May 9 said it would defer action on a beach structure at Stop 42 while state regulators review the site.
Council member Tim McCarthy told residents the Village was "stepping aside" while the State investigates the matter. Several residents pressed the council for action during the meeting’s public-comment period.
Caroline Rogers, who told the council she owns the land where the structure was built, said she had applied for a permit with EGLE and the Building Department and that she was "not trying to be defensive but I didn’t know I was doing anything wrong." Building Inspector Bill Lambert told the council the structure on 42 had been permitted to a different address than where it was constructed, a discrepancy he reported to the body.
Resident Kathleen Hogan Morrison asked whether the Village intended to take any steps, and whether residents should contact EGLE. McCarthy said the Village could not direct individual residents on how to proceed and that it would let the state review "play out." Other residents, including Bill Schutt and Lynn and Joel Altschul, raised concerns about road ownership, beach access and the safety and appropriateness of the structure.
The meeting produced no final action on the structure. The council and residents said they would await the State’s review; several speakers referenced EGLE (the Michigan Department of Environment, Great Lakes, and Energy) as the agency currently examining permits and compliance.
