Planning commission backs allowing shipping containers for bona fide agricultural use

At a meeting of the Beaufort County Planning Commission, the body voted unanimously to recommend County Council approve a text amendment to the Community Development Code that would allow shipping containers to be used as accessory structures for bona fide agricultural operations.

The change (case number CDPA 0000572025) was introduced by Planning Director Robert, who told commissioners the proposal clarifies definitions, increases required screening from 100 feet to 200 feet, explicitly lists hazardous materials, and removes a proposed annual inspection requirement after code enforcement advised against yearly monitoring. "It's our favorite topic again," Robert said, summarizing staff's approach to balancing farm efficiency with regulatory clarity.

Commission members questioned enforcement and permit details. Glenn asked whether illegal uses would constitute a code violation and what penalties would apply; Robert replied that misuse would be treated as a zoning violation, typically enforced through complaint-driven inspections, civil penalties that accrue daily and, if unresolved, magistrate proceedings. Staff said permits would be issued as a paper package and agreed to review permit forms to ensure they clearly notify applicants of potential enforcement actions. Staff also said the typical permit has a two-year construction window and, once the structure is built, the permit generally runs with the property.

Commission member John moved the recommendation to County Council, including the hazardous-waste wording clarification; the motion was seconded and passed unanimously. The commission's recommendation will be forwarded to County Council for their review and any further action.
