Casco board authorizes stepped-up enforcement for business at 50 Rabbit Run

The Casco Select Board on July 7 authorized staff and town legal counsel to pursue stepped-up enforcement against a property at 50 Rabbit Run that the town says has continued business activity despite an existing cease-and-desist order.
The manager briefed the board: the property owner appealed a denial of a home-occupancy permit and has applications pending with the Zoning Board of Appeals (scheduled July 20) and the Planning Board (initial review July 27). “Cease and desist order was issued to the property at 50 Rabbit Run, and that does remain in effect. Despite this order, the business activity of the property has continued,” the manager told the board.
Staff told the board that code-enforcement has received recent complaints about traffic volumes at the site and requested authorization to work with legal counsel to elevate enforcement, potentially seeking daily fines and court-ordered remedies including locking the premises if warranted. When a board member asked what “increase” would mean, staff described possible court filings, civil fines and requests that a court order doors locked as compliance remedies.
A board member moved to authorize "further enforcement business at 50 Rabbit Run to enforce the cease and desist, stop work order issued by the CEO in May, including initiating court proceedings if that becomes necessary." The motion was seconded and the board authorized legal counsel to proceed.
Staff will coordinate next steps with legal counsel and inform the board of any court filings and hearing dates; the property owner’s pending appeals remain scheduled with the Zoning Board of Appeals and the Planning Board in late July.
