Prospective ZBA alternate told to follow RSA and DES rules when taking over grandfathered junkyard

The Temple Zoning Board of Adjustment discussed licensing and environmental obligations for a grandfathered junkyard that Russel Wilson said he plans to take over.

Ken Caisse told the board that the property is a junkyard and that Wilson will take it over; he noted that the handouts provided to Wilson are not exhaustive and that there are additional Department of Environmental Services (DES) requirements and RSA rules to follow. The board specifically referenced RSA 2611-236:129 and noted stipulations that include yearly inspections and environmental protections.

When asked whether he planned to expand operations, Wilson said he does not plan to increase the yard’s footprint and intends to proceed cautiously. Board member Steve Andersen cautioned that "it is very difficult to expand grandfathered properties and it's an uphill battle," noting practical constraints on enlarging preexisting uses.

The board indicated Wilson must be aware of licensing steps and statutory requirements as he assumes responsibility for the site; no formal licensing decision was made at the March 26 meeting. The board later discussed recommending Wilson for an alternate position on the ZBA, but the transcript records only the motion and second and does not record a final vote on that recommendation.

Any changes to the junkyard’s operation, including new vehicles or increased activity, will be subject to the town’s licensing process and the environmental and inspection obligations cited by the board.
