Selectman Daniel Staples told the board that Maine Municipal Association (MMA) advised the town's Building Notice Ordinance must reference the correct state statute and include an expiration date on permits. The board agreed the ordinance should cite Title 30-A M.R.S.A. §4452 and moved to amend the ordinance and place the amendment on the Nov. 8, 2016 ballot.
The Selectmen voted to hold a public hearing on Oct. 10, 2016, at 6:00 p.m., immediately before the regular meeting, to take public comment on the proposed amendments. The motion to amend the ordinance and the motion to schedule the hearing both carried 5-0-0.
The change stems from a legal-phrasing requirement: fees and fines must be referenced under the state statutory authority cited by MMA. The board's action is procedural—the town will hold the public hearing and allow voters to decide on the amendment in the Nov. 8 election. The town clerk will publish notice and provide copies of the proposed language in advance of the hearing.
