Member Marvin Kropke moved to allow his remote participation at the Board's July 8 and July 22 meetings under Government Code Section 11123.2; Management Member Judith Freyman seconded the motion and the Board approved it 3-0. The Board also approved the minutes of its June 3, 2026 meeting on a motion by Kropke, seconded by Freyman, by the same 3-0 tally.
The Board then reviewed a set of petitions for reconsideration and appeal status items. The panel voted 3-0 to issue an Order Taking Petition for Reconsideration Under Submission for Boulay Construction (1625267) (motion by Marvin Kropke; seconded by Judith Freyman). The Board voted to reinstate the appeal in Imperial Scaffolding, Inc. (1777078) (moved by Marvin Kropke; seconded by Judith Freyman; vote 3-0). It likewise voted to take under submission the petition in the Los Angeles Department of Water and Power matter (1401587) and in the Tesla, Inc. matter (552002), each by recorded 3-0 votes with Kropke and Freyman as the mover and seconder in the minutes.
The Board also issued a Denial of Petition for Reconsideration (case referenced in the minutes as 1691261), moved by Marvin Kropke and seconded by Judith Freyman, which carried 3-0. Several other appeal dismissals and denials of late appeals were discussed by the Board during the session; the public minutes list those matters but do not record substantive floor debate for each item.
