The Commission voted to issue the Certificate contingent upon installation of the remaining required plantings and continued applicability of standard ongoing conditions (survival/replacement requirements and prohibition on herbicide use); the motion passed 5–0 with Commissioner Fernando recused.
The Commission recorded the contingency clearly so that issuance is tied to completion of the plantings and ongoing permit conditions.
