Shelby council approves vacating city lots to allow Meadows Subdivision replat

The Shelby City Council on Sept. 3 adopted Resolution 9-24 to vacate Lots 1, 2, 3, 4, 9, 10, 11 and 12 in Block 6 of Caughran, Davis & McEwen’s Addition, authorizing the city-owned parcels and right-of-way to be replatted as the Meadows Subdivision. The vote was by roll call and recorded as all ayes; the motion carried.
At a public hearing held under Iowa Code sections 354.22 and 354.23, resident Amanda Hudson asked whether the proposed vacation would affect her property, which includes an alley that had previously been vacated in the same plat. Attorney Clint Fichter responded that Hudson’s property would remain unchanged by the current vacating action.
The resolution directs city staff to proceed with the administrative steps needed to replat the vacated lots for the Meadows Subdivision and reflects the council’s acceptance of the zoning and platting procedures required by state law. The city did not record any public objections during the hearing and Mayor Ron Kroll closed the hearing at 7:09 p.m.
The vacated lots are specifically listed in the resolution as Lots 1–4 and 9–12 in Block 6 of Caughran, Davis & McEwen’s Addition to the Town of Shelby. The council’s action follows the notice and hearing requirements of Iowa Code 354.22 and 354.23. There were three council members voting in favor (Jackie Hursey, Pat Honeywell and Karen Schlueter); two members were absent (Todd Frank and Traci True). The council did not record any amendments or conditions to the resolution during the meeting.
Next steps include the city completing the replat process and filing the necessary documents to reflect the new subdivision layout. No timeline for final plat approval was specified during the meeting.
