Chair affirms planning commission's grant of fill permit for petition 2601

The Chair of the Hobart City Redevelopment Authority moved and the board voted to affirm the planning commission’s decision to grant a fill permit under petition number 2601, citing the written record and applicable municipal rules.

"Having considered all of the evidence presented both in writing and on the record," the Chair said when making the motion to affirm, citing Hoover Municipal Road Section 15904 as the provision governing fill permits. Staff advised members the authority may affirm, modify or reverse the planning commission decision and that each appellant will receive written notice of the outcome.

Several parties who filed appeals were read into the record before the vote; the transcript includes a series of names read aloud and lists an appearance by Eric Morris on behalf of Stonematals LLC and Erin Bennett among others. Several names in the roll call were not clearly recorded in the transcript. The board did not provide a roll-call vote in the record; members responded by voice vote with the Chair calling the result "Aye."

The decision completes the authority’s review of petition 2601. Staff said written notices of the authority’s decision will be mailed to the appellants and outlined the limited options for further appeal available under local procedure.
