Chesterfield planning board opens hearing and grants waiver for minor subdivision at 1453 Route 9

CHESTERFIELD, N.H. — The Town of Chesterfield Planning Board voted unanimously on May 4 to find a minor subdivision application for 1453 Route 9 (Map 11B, Lot A13) complete, open the public hearing and grant a waiver from Sections 403.2 B 2 and 403.2 C of the Chesterfield Land Regulations, minutes show.
Joe DiBernardo, of DiBernardo Associates LLC, presented the plan for the property and said the proposal divides the parcel into two lots, “one with the business building and one with the house.” Chairman Joe Brodbine read the applicant’s waiver request to the board.
Vice Chairwoman Maria Bissell asked why a driveway located in the rear setback was not being removed. After discussion the board’s majority determined the driveway is preexisting and not an issue for the current application.
Planning Board member James Hancock moved that the application be deemed complete after the submission checklist review and to open the public hearing; Selectman Representative Fran Shippee seconded and the motion passed unanimously. Hancock later moved to grant the requested waiver from Sections 403.2 B 2 and 403.2 C of the Chesterfield Land Regulations, finding strict conformity would pose an unnecessary hardship and that the waiver would not be contrary to the spirit of the regulations; Secretary Beverly Bernard seconded and the waiver was approved unanimously with the condition that the application be corrected to indicate the waiver request.
The minutes record the board opening the public hearing and granting the waiver; no final subdivision approval is recorded in these minutes. Further review, public comment or subsequent hearings are implied by the opening of the public hearing but are not recorded in the May 4 minutes.
