Planning Commission recommends Hold Harmless Agreement for garage encroaching into drainage easement

The Grantsville City Planning Commission recommended that the City Council approve a Hold Harmless Agreement for a detached garage constructed within a recorded private drainage easement at 641 S Maxwell Drive.

Planning and Zoning Administrator Shelby Moore told commissioners that the garage is outside the retention basin itself but within the recorded easement that grants the City access to perform maintenance if necessary. An engineering analysis submitted by staff found about 1,300 cubic feet of pond storage and roughly 4,000 cubic feet of freeboard remained, which Shelby said exceeds the required detention capacity for the basin. Shelby also reported that Comcast, Rocky Mountain Power and Enbridge provided releases for any affected utility easements.

At the public hearing, William Denham, a licensed civil engineer, told the commission he did not believe the garage created drainage or runoff concerns and suggested a plat amendment to modify the easement rather than the Hold Harmless Agreement.

Commissioners debated legal and policy implications. Commissioner John Montgomery expressed concern that approving the agreement could establish a precedent allowing property owners to build first and seek approval later; others said the evidence showed no current engineering problem and noted the utility releases and staff review. City Attorney Tysen Barker advised that the Hold Harmless Agreement reduced the City's legal exposure by documenting protections should unforeseen issues arise.

Jason Hill moved to recommend approval of the Hold Harmless Agreement; Cameron Moulton seconded. The motion passed 4–1: Sarah Moore, Jason Hill, Gary Merrill and Cameron Moulton voted yes; John Montgomery voted no.

The commission’s recommendation will be forwarded to the City Council for final action.
