Zoning board denies rehearing on Don Gerry Road case, notes withdrawal and schedules Fox Run continuance

The Bristol Zoning Board of Adjustment denied a Motion for Rehearing filed by abutter Laurel Shaw concerning Special Exception #26SPX02 (28 Don Gerry Road) by a 5-0 vote on June 2, finding the rehearing request did not identify legal error or demonstrate that the prior decision was unreasonable.
Staff read Shaw’s request into the record and the board reviewed the history of two prior hearings (March 2 and May 4). Chair Larry Denton said the board found the Notice of Decision and the record adequately addressed issues raised; based on that review he moved to deny the rehearing and the motion carried unanimously.
Separately, staff reported that a second Motion for Rehearing (26REH03) concerning the same address was withdrawn because the applicant sold the property and no longer had standing. The board also noted an applicant for a Fox Run variance (26VAR03) requested and received a continuance to July 7 so the project engineer could address drainage concerns.
The board additionally approved the May 5 meeting minutes with several textual corrections and adjourned at 7:35 p.m.
