Poseyville council unanimously adopts ordinance targeting utility equipment tampering

The Poseyville Town Council on Feb. 11 adopted Ordinance 2025-02-11-01 addressing tampering with utility and infrastructure equipment, voting unanimously to suspend the second-reading requirement and enact the measure immediately. Council President Justin Rutledge opened the item and asked for motions; Councilman Randy Rankin moved to accept the first reading, and Councilman Mike Baehl seconded both the suspension of the second-reading rule and the final passage.

The ordinance was revised and reviewed by legal counsel before the meeting, and council members said they moved quickly because of a rising number of violations. "Due to the number of violations, the ordinance should be enacted as soon as possible," Rankin said at the meeting. After suspending the second-reading rules, the council voted to pass the ordinance by roll call: Justin Rutledge, Mike Baehl and Randy Rankin all voted yes.

The immediate enactment means penalties and enforcement provisions contained in Ordinance 2025-02-11-01 take effect without the usual delay between first and second readings. The council did not enumerate specific enforcement actions during the meeting; legal counsel reviewed the revised language in advance. The council indicated the measure was a response to repeated incidents involving utility infrastructure on town property.

The council did not take additional, separate action on associated enforcement policy during the meeting. The next steps will depend on how town staff and legal counsel implement the ordinance’s provisions.
