Fayette County objects to Fayetteville annexation over proposed jump from ~37 to 315 homes

Planning and Zoning Director Deborah Bell advised the Board that the City of Fayetteville submitted a Step Two annexation request for four parcels (Parcels Nos. 0704 009; 0704 014; 0704 016; and 0704 045) totaling roughly +/-37 acres and fronting on State Route 54 West and Lester Road. The applicant proposed rezoning to PCD (Planned Community Development); the current Fayette County zoning is A-R (Agricultural-Residential) and the County's Future Land Use designation is Office.
Bell told commissioners that the proposed PCD zoning is significantly more intensive than the County's Future Land Use Plan and would increase residential density from an estimated 37 homes to about 315 homes, with attendant transportation and infrastructure impacts. She said staff recommended objection under O.C.G.A. 36-36-113 because of the change in use and density.
County Attorney Dennis A. Davenport told the Board that filing two separate annexation petitions in the same vicinity had created an unincorporated island and raised procedural concerns; he said such requests must be reviewed on the facts as presented. Commissioner Eric K. Maxwell called the proposed arrangement a likely “complete disaster” for traffic in that corridor, and Chairman Lee Hearn emphasized the importance of protecting the County's Land Use Plan.
Vice Chairman Edward Gibbons moved to object to the annexation; Commissioner Maxwell seconded. The motion passed 4-0. The Board separately reviewed and did not object to a Step Two annexation for nine parcels (16.611 acres) at 1336 Hwy 54 W because staff determined that rezoning there would be analogous to existing County office zoning and would not create the same impacts. The Board also did not object to a Town of Woolsey request to annex a 20.34-acre portion of Parcel No. 0442 005.
