The Town of Sherman Planning & Zoning Commission unanimously approved an amendment to Section 610 of the zoning regulations on April 9 that adds an "Art Gallery — Operated Not for Profit" definition to allow nonprofit organizations to exhibit and sell visual art and run community arts programs.
At a public hearing on the amendment, Linda Hubbard, speaking for the Sherman Artists Association, explained the proposal is written for organizations registered as 501(c)(3) entities and would permit exhibition and sale of two‑ and three‑dimensional visual works, studio or teaching space and fundraising openings. The record also included a written communication from Tucker Beckett, director of the Western Connecticut Council of Governments (WESTCoG), which the clerk read into the record noting "no impact concern." Two residents, E. DiFranco and E. Langster, spoke in favor; no speakers opposed the amendment.
Commissioners said the language clarifies an existing reference to 501(c)(3) organizations in other sections of the regulations and limits the definition to tangible visual arts. After deliberation the commission voted to adopt the definition; the motion was made by Commissioner A. Weisberg, seconded by Commissioner J. Siegel, and carried unanimously. The amendment is recorded with an effective date of May 1, 2026.
The new definition specifies that a nonprofit gallery may exhibit and sell fine arts and crafts, provide space for community creation and teaching programs, and host openings and fundraising events for works by members and nonmembers. The Commission requested follow‑up work to consider whether parallel language should be drafted for for‑profit galleries in the C zone, an item the chair said will be placed on a future regulatory review track.
The Commission's approval was made on the record during its April 9 meeting at Mallory Town Hall. The amendment text and effective date will be reflected in the town's zoning regulations once the administrative adoption process is complete.
