Division Street update: council hears bonding and payback options as annexation questions persist

City staff updated the council on the Division Street project and a possible reimbursement to Johnson County. Staff said engineers will review the ten-year agreement back to Oct. 1, 2020, which changed the calculations and produced an estimated payback of about $118,000; staff also said the county chair indicated the city could spread repayment over up to five years and that repayment could be built into a future TIF agreement if property owners seek annexation.
The council discussed the availability of Division Street bond funds (staff cited roughly $350,000 remaining) and said they would check with the bonding attorney before using bond proceeds for reimbursement to ensure compliance with bond covenants. Staff noted the bonding attorney was out on vacation and that a final determination could take a few weeks once counsel reviews the matter.
Several residents and landowners asked about annexation advantages and constraints, including city vs. county construction standards, minimum acreage requirements under county rules (county requires 40 acres per unit, the city does not), and how buildable acreage is affected by wetlands or floodplain conditions. Staff said annexation and financing decisions will follow the attorney’s and bonding counsel’s advice before the council takes further action.
