Representatives from the Posey County Area Plan Commission — Joe Marvel and Jerry Cotner — and consultant Debbie Luzier presented the draft UDO language and answered council questions.
During the presentation, Jared Baehl, speaking for Nix Companies, said the UDO’s definition of impervious surfaces could constrain existing businesses seeking to expand. The Area Plan Commission representatives said they would provide recommended ordinance language intended to maintain countywide uniformity while addressing incorporation‑area concerns. Attorney Brenda DeVries explained the statutory annexation process and said accountant Robert Reynolds (LWG, Inc.) will prepare the fiscal plan required for the annexation hearing and public review.
The council voted to hold the combined public hearings on March 31; both the UDO and the annexation item will be open for public comment and the town will publish the fiscal plan and recommended ordinance language before the hearing. The hearing is the next formal opportunity for residents and businesses to present objections or proposed amendments.
