Election board asks county for $50,000 as appeal of party‑discipline case continues

An election board representative told the Brown County council during its July 9 work session that the board needs an additional $50,000 for legal expenses because a lawsuit related to party disciplinary proceedings has exhausted the 2026 allocation. The board reported it is currently $10,906.23 over budget and that legal costs so far this year exceed $53,000.

The representative said the litigation began after local GOP party action removed two local figures from party roles for five years, then was upheld by the Indiana GOP. According to the presentation, Richard Stanley and Tim Clark then filed suit, first in the Southern District of Indiana (dismissed) and now in the U.S. Court of Appeals for the Seventh Circuit in Chicago, where the appeal remains pending. The speaker described the litigation as the reason the election board has had “extras that came during the primary election” and asked the council to consider allocating additional funds to cover potential further legal fees.

Councilors pressed for clarification on prior allocations and totals that feed the current shortfall. One member summarized earlier budget actions: baseline legal funding plus an additional $42,000 previously authorized and a small carryover from 2024, producing close to the amounts now under discussion. Members debated whether to approve an emergency appropriation immediately or wait for the regular meeting so the clerk or staff could present formal paperwork; several members said the appropriation would need to be advertised if acted on outside the regular meeting process.

The chair and other members said they were open to addressing the request but preferred that the clerk (or staff) present the formal documentation at a regular meeting so the council could take an advertised, recorded action. No formal appropriation vote was recorded during the work session.
