Penfield board authorizes EAF and approves conditions for three‑lot Creek Street subdivision

At the July 9 work session the Penfield Planning Board reviewed updated plans for a three‑lot single‑family subdivision at 1573 Creek Street and accepted staff’s recommendation to move forward with environmental review paperwork.
Staff reported the applicant shifted one house 10 feet east to reduce impacts to a woodland area and provided responses to prior PRC comments. Staff said the new plans keep development clear of steep slopes and minimize woodland disturbance; a waterfront assessment was submitted and staff judged the project consistent with the town’s LWRP review area.
Town planning staff presented a draft Part 2 EAF and recommended a negative declaration. The board discussed conditions including a recorded shared‑driveway/utility easement between Lots 2 and 3 (to be filed with the county clerk before any building permit), operational protections for the nearby pump station, and deed restrictions to limit future subdivision as a condition of approval. The applicant indicated the deed restriction would be acceptable.
Chair moved to authorize the chair to sign the EAF and for staff to draft the approval resolution incorporating the conditions; the motion carried. Staff will prepare the final approval resolution that includes the easement, pump‑station protective measures and a deed restriction to limit further subdivision of the approved lots.
