Bethania board approves up to $13,500 for roads survey; mayor recuses

The Town of Bethania Board of Commissioners voted Sept. 5 to authorize up to $13,500 to fund a required survey of Queens Grant and Bear Creek Roads, a step officials said is necessary before deciding between a homeowners association or a road maintenance agreement for the Bethania Forest neighborhood.
Resident Niki Calhoun told the board members that neighbors are weighing HOA versus a Road Maintenance Agreement and had “multiple concerns regarding the cost estimates for a survey, between $8,000 and $13,000.” Commissioner Johanna Brown moved that the Town pay up to $13,500 for the survey; Commissioners Brown, Michelle Leonard, Kenneth Wolff and Tom Beroth voted in favor. Mayor Brent Rockett recused himself from the vote because he resides on Bear Creek Road.
Town attorney Dovel said he will research whether it is appropriate for the Town to pay attorney fees for Bethania Forest homeowners; he noted such payments could present a conflict of interest because the Town anticipates eventually turning the streets over to the homeowners. The board did not make a decision on attorney fees during the meeting.
The vote follows the town’s recognition that Queens Grant and Bear Creek Roads are now on Bethania’s street system and that a survey is required before a formal agreement can proceed. Next steps identified at the meeting include completing the survey funded by the approved amount and receiving Attorney Dovel’s guidance on potential payment of homeowners’ attorney fees.
