On May 7 the City of Eagle River Plan Commission recommended City Council adopt an amendment to Chapter 106 (Zoning) that adds a definition of "Excavation." Commissioners amended the proposed language to change the minor-excavation exemption threshold from 500 cubic yards to 500 cubic feet.
The adopted definition in the motion describes excavation as any man-made cut, cavity, trench, depression, hole or open pit formed by removal of soil, rock, sand, gravel or other material, whether by mechanical equipment, hand tools, blasting or other means. The motion explicitly excludes minor landscaping grading that does not exceed 12 inches in depth or 500 cubic feet in volume and routine maintenance activities exempted elsewhere in the code. The motion (by Commissioner John Hletko, seconded by Commissioner Adam Grassl) carried on a roll call vote recorded in the transcript as "all."
