Conservation Commission issues Order of Conditions for garage at 738 Mountain St.

The Sharon Conservation Commission voted on April 23 to close the Notice of Intent hearing for proposed garage construction at 738 Mountain Street and to issue an Order of Conditions to the property owner. Representative Brad Holmes told the commission the owner was willing to protect approximately 18,000 square feet on the northern portion of the lot and proposed mitigation including removal of some poured concrete currently in the buffer, native plantings, and a two-foot-wide gravel strip around the new garage to capture roof runoff. Holmes said the mitigation area would total about 1,250 square feet.

The parcel is within a groundwater-protection district, which imposes added limits on allowable work within the 100-foot wetland buffer. Building Inspector David Abbott confirmed that, with a reduction in the garage foundation, light-duty construction under 600 square feet is permissible and a 480-square-foot foundation would be acceptable for the proposed structure. Commissioners agreed to close the hearing and issue the Order of Conditions with a condition that conservation-restriction language be finalized by Oct. 1 so it can be recorded with the Norfolk County Registry of Deeds. The recorded roll-call vote was: Drisko – aye, McKeen – abstain, Wasserman – aye, Geller – aye, Cremer – aye, Arguimbau – aye (5-0-1).

The commission’s file will require the applicant to complete the conservation restriction language by the Oct. 1 deadline before final registration; additional permit conditions include the mitigation plantings described to offset new impervious area.
