South Hill Town Council certifies closed session, approves $65,000 settlement appropriation

The South Hill Town Council on Jan. 3 unanimously certified a closed session held to consult legal counsel on pending litigation and approved a $65,000 appropriation from the FY25 undesignated general fund balance to settle Hawkins v. Town of South Hill.
The special meeting was called to order at 4:00 p.m. by Mayor Mike Moody at the temporary council chambers in South Hill Town Hall. Councilor Gavin Honeycutt moved, seconded by Councilor Delores Luster, that the council enter Closed Session under Virginia Code § 2.2-3711(A)(7) to consult with legal counsel regarding actual litigation; the motion carried unanimously and the mayor announced the council was in Closed Session. Town Manager Keli Reekes attended the closed session in person and attorney Missy York, legal counsel assigned by the Virginia Shared Risk Association, participated by conference call.
After the closed session the council reconvened in open session. Councilor Honeycutt moved and Councilor Luster seconded a resolution certifying that, to the best of each member’s knowledge, only matters lawfully exempted from open meeting requirements under the Virginia Freedom of Information Act were discussed in the closed session and that only the matters identified in the motion to convene the closed session were considered. The resolution passed on a roll-call vote with Councilor Lillie Feggins-Boone, Councilor Jenifer Freeman-Hite, Councilor Ashley Hardee, Councilor Gavin Honeycutt, Councilor Delores Luster, Councilor Carl L. Sasser, Jr., and Councilor Michael Smith each recorded as "Aye."
Following certification, Councilor Honeycutt moved, and Councilor Lillie Feggins-Boone seconded, to appropriate $65,000 from the FY25 undesignated general fund balance to cover settlement funds in the Hawkins v. Town of South Hill case. The motion "to appropriate $65,000 from the FY25 undesignated general fund balance in settlement funds regarding the Hawkins vs. Town of South Hill case" carried unanimously.
There was no further business and Mayor Mike Moody adjourned the special meeting at 4:35 p.m. The minutes of the special meeting were prepared by Interim Clerk Kristine Martin and left to be approved at a later date.
