Council: dispensary drive-through may be allowed only if all transactions occur on private property

Representatives of the Dino Dispensary appeared May 27 to seek guidance on several proposals, including a drive-through sales window, exterior artwork, a possible tax overpayment and a request to extend operating hours.
Town staff told the Town Council the proposed drive-through conflicted with existing Town easements and Marijuana Enforcement Division (MED) requirements that marijuana transactions may not occur on public property or within public easement areas. Lando Blakely (joining via Zoom) and Chara Garcia (in person) explained site improvements had already begun and said they were unaware an easement extended to the building. Council members discussed driveway access, drainage, utility easements, security, camera placement and lighting and said they would support a drive-through only if all transactions take place entirely on private property and all MED requirements are met. The applicant agreed to redesign the project and submit revised plans; staff will work with the applicant on permits, culvert requirements, driveway access and modification-of-premises approval, according to the meeting minutes.
Council also addressed public concerns about artwork on the building. The applicant said preliminary sketches were removed and that the final mural would be designed to support tourism and be community-appropriate; Councilmembers generally expressed support for public art and additional dinosaur-themed attractions.
The dispensary owner told the Council a prior manager may have miscalculated local marijuana taxes and possibly overpaid the Town for several years. Staff advised that verification would require documentation — including gross sales reports, inventory records, sales records and MED reporting — and described potential audit and accounting procedures; no determination about refunds or credits was made pending that review.
On business hours, the dispensary asked the Council to extend allowed hours from the current 10 a.m.–8 p.m. to 10 p.m. Council discussed impacts on neighboring residents, traffic, law enforcement staffing and public safety and emphasized the need for public input. The Council directed staff to gather feedback through utility billings, Town Hall outreach, the Town newsletter, social media and other channels and to return the matter for future consideration. No formal ordinance change or vote occurred at the meeting.
The actions recorded in the meeting minutes related primarily to design direction and requests for information; no final regulatory changes or approvals were made.
