The Overland City Board of Adjustment unanimously approved a series of variances on Jan. 14 that will allow the owner of 2636 Woodson Road to occupy the building as a contractor's office for a roofing company, with no on-site storage of materials or vehicles.
The board's actions grant reduced setbacks, waive landscaping and screening requirements, and cut the parking requirement for general office use from six spaces to four. Chair Jeff O'Connell presided over the hearing and polled four members for every vote; each motion passed with a 4-0 vote.
Why it matters: City staff told the board that the property had been vacant for 180 days or longer, which under city code caused the site and use to lose their prior nonconforming status. Planning and Zoning recommended approval of the conditional use permit and site plan on the condition that the board approve the variance requests needed to meet current code deficiencies.
What was requested: Applicant Andres Garcia Salgado, the current owner, said the variances were needed to occupy the building and that no on-site storage would occur. Special Counsel Joseph Bond characterized the proposal as a "like for like use," noting a prior tenant had operated a tree contractor's office at the location and the building has been on the site since 1945. Staff and the applicant emphasized that the building footprint leaves little room for required landscaping.
Votes and motions: The board approved the following variances by separate motions, each carried unanimously: - Front yard setback: allowed one-foot front yard setback in lieu of the 30 feet required by Section 400.230.D.4.a. (motion by Jay Fetsch; second Dan Kipper). - South side yard setback: allowed zero-foot setback in lieu of 12 feet under Section 400.230.D.4.b. (motion by Jay Fetsch; second Jon Seal). - North side yard setback: allowed a two-foot setback in lieu of 12 feet under Section 400.230.D.4.b. (motion by Jay Fetsch; second Dan Kipper). - Frontage screening and landscaping: waived required front landscaping under Section 400.450.A.2 (motion by Jay Fetsch; second Jon Seal). - Interior screening and landscaping: waived required interior landscaping under Section 400.450.A.4 (motion by Dan Kipper; second Jay Fetsch). - Perimeter screening and landscaping: waived perimeter landscaping under Section 400.450.A.11 (motion by Dan Kipper; second Jay Fetsch). - Parking: allowed four parking spaces instead of six required under Section 400.470.B.3 for general office use (motion by Jay Fetsch; second Dan Kipper).
Board discussion and public input: The transcript records no substantive questions or objections from board members and no comments from the public during the hearing. Staff noted Planning and Zoning's review and recommendation; the applicant declined to introduce additional exhibits beyond those submitted in advance (Exhibits A-1 through A-12).
Next steps: The board did not attach additional conditions beyond the variances documented in the approved motions. The meeting adjourned at approximately 6:20 p.m.
