Byron council approves variance for Ed Roby to build shop closer to property line

The Byron Town Council approved a variance requested by Ed Roby to allow his new shop to be sited 6 feet from the north property line and approximately 7 feet (roof overhang) from the east property line, where Ordinance 11 ordinarily requires 10 feet. Zoning Administrator Richard Hawley and Planning & Zoning member Dan Bodtke inspected the property and recommended approval based on existing site constraints, including an underground power line that would be impacted by a different placement.
Karma Sanders moved to approve the variance and Brandon Hessenthaler seconded; the motion passed unanimously. Mr. Roby submitted the required compliance permit and must pay the associated fee; Mayor Allan Clark will sign the permit and Tuffy Brost will perform the final inspection. Council noted no further paperwork beyond the compliance permit was required.
The council also discussed that ordinances vary between residential and other zones (some zones allow 5-foot setbacks) and that legal compliance with Title 11 remains the responsibility of the property owner and town staff.
