HILLSBOROUGH, N.H. — The Hillsborough Planning Board voted Sept. 18 to approve a two‑lot subdivision at 57 School Street that will allow a duplex on each new lot, granting waivers to local zoning requirements and attaching conditions before building permits can proceed.
Planning Director Robyn Payson introduced the application from Knight Brothers Development LLC and said the submission requested two waivers: to waive the 20,000‑square‑foot buildable‑land requirement for duplexes and to allow iron rods rather than stone bounds to mark front corners. Engineer Timothy Bernier of Hoyle Tanner Associates presented the plan and described site constraints including wetlands and setback limits that reduce buildable area.
The board voted to grant both waivers and to accept the application for review. Following public‑hearing procedure, the board approved the subdivision plan as presented. The approved plan will subdivide Assessors Map 24 Lot 21 into Lot 21 (0.510 acres) and Lot 24 (0.614 acres), as shown on the plan prepared by T.F. Bernier dated August 2024.
Conditions of approval require that a driveway permit be submitted to the New Hampshire Department of Transportation for each lot and that Change of Use applications be filed with the Water/Sewer Department for each proposed duplex before further permitting. "They would start out as rentals," Bernier said when asked about the intended initial use for the units. Planning Director Robyn Payson said the applicant "needed to get a change of use for the duplexes."
Board member Bryant Wheeler recused himself from the matter and Chair Susanne White appointed alternate Dana Clow to vote in his place for this item. The motion to approve the plan was moved by Steve Livingston and seconded by Jim (James) Bailey and, according to the minutes, carried unanimously.
The approval includes the findings of fact recorded in the minutes, which name Knight Brothers Development LLC (c/o Christopher Knight) as the property owner and state that the lots meet other zoning requirements aside from the waived buildable‑land standard.
The board did not specify a numeric roll‑call tally in the minutes. The board will not issue any permits that require DOT approval or a Water/Sewer change of use until the stated conditions are satisfied.
