The Williston Board of City Commissioners voted to approve the vacation of a 4,715.43-square-foot (0.11-acre) section of street right-of-way near Freedom Church on Aug. 27, contingent on the applicant providing a stormwater-pipe easement and completing a quiet-title action for Tract C.
Kent Jarcik, city planner, described the Development Review Committee’s recommendation that the applicant either show an existing easement for the storm sewer or provide a new city storm-sewer easement and that the city reserve a public right-of-way on Tract C for future planning considerations. The committee also noted the presence of a stormwater pipe in the southeast corner of the property.
During the public hearing, Jason Wenaas, lead pastor of Freedom Church, said the current building was constructed in 1957, is an important neighborhood landmark and that the church’s planned improvements are intended to maintain code compliance and benefit Williston.
Attorney Taylor Olson clarified that the city would not finalize the vacation until the applicant provided a quiet-title determination for Tract C. Commissioner Brad Bekkedahl moved approval; Commissioner Tate Cymbaluk seconded. The recorded vote was AYE: James Bervig, Tate Cymbaluk, Brad Bekkedahl, Howard Klug; ABSTAIN: Victoria Siemieniewski. The motion carried 4-0 with one abstention.
The condition requiring an easement and quiet-title action remains outstanding; the city’s approval will not be finalized until those items are provided to the city.
