Commission approves 24-foot peak height exception for accessory building at Center Oak property

The Town of Merton Plan Commission on May 6 approved a request to exceed accessory-structure height limits, allowing a peak height just under 25 feet for a proposed building at N91W29517 Center Oak (Tax Key MRTT0295-999-007). Planner Marilyn Haroldson told the commission the proposed structure meets setback requirements and otherwise complies with the zoning code.
Bill Canfield of Canfield Custom Buildings said the project will remove two existing buildings before construction and that the new structure "will actually fit in the footprint of those two buildings." He said the property owner has a hobby of restoring cars and intends to install a car lift in the structure. Haroldson noted that although part of the property is in Waukesha County’s jurisdiction, the proposed building sits outside the county portion so county staff did not need to weigh in on this structure.
Commissioner Queoff moved to approve the height exception per section 17.21(2)(e), conditioned on the applicant submitting building plans to the Building Inspector and receiving a building permit; Commissioner Good seconded, and the motion carried.
The commission recorded no roll-call tallies in the transcript. The approval allows the owner to proceed with building-permit submittal and construction planning under the stated conditions.
